5. What Happens Next

We acknowledge the notice by email, review it, and remove or disable access to the material promptly if the notice is complete. We notify whoever supplied the material and give them a copy of the notice so that they can respond.

6. Submitting a Counter-Notice

If your material was removed and you believe it was removed in error, email a counter-notice that includes:

1. Your physical or electronic signature.
2. Identification of the material removed and where it appeared before removal.
3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed by mistake or misidentification.
4. Your name, mailing address and email address.
5. A statement that you consent to the jurisdiction of the federal district court for your address, or for Litchfield County if you are outside the United States.
6. A statement that you will accept service of process from the person who filed the original notice.

If we receive a valid counter-notice, we forward it to the original complainant and may restore the material in 10 to 14 business days unless they tell us they have filed a court action.

7. Repeat Infringers

We end the access of anyone who repeatedly posts or supplies infringing material.

8. Misrepresentation

Under section 512(f) of the DMCA, anyone who knowingly misrepresents that material is infringing, or was removed by mistake, may be liable for damages including costs and attorney fees.
